Tepic, 08 de mayo de 2022.- Garantizar el derecho a vivir de manera digna y proteger el patrimonio de los adultos mayores, tiene como propósito la iniciativa para reformar el Código Civil para el Estado de Nayarit, presentada por el diputado Pablo Montoya de la Rosa.
Ante el pleno de los representantes populares, el diputado local hizo referencia a situaciones que han pasado los adultos mayores debido a que en vida dan herencia a sus familiares, “una de las prácticas más recurrentes es la de personas de la tercera edad que son despojadas de su patrimonio, debido a que heredaron en vida a sus familiares y estos, a su vez, reaccionan dejándolas sin bienes inmuebles y en estado de desamparo”, enfatizó.
“Con la vigilancia del Notario Público para incluir la cláusula de usufructo vitalicio sobre los bienes otorgados, se velará por la protección de los bienes inmuebles de las personas adultas mayores y se les garantizará el derecho a vivir de manera digna; ello se logrará modificando el Código Civil para el Estado de Nayarit, propuesta que hoy pongo a su consideración”, puntualizó Montoya de la Rosa.
El legislador local comentó que incluir la cláusula de usufructo vitalicio al Código Civil, permitirá que los adultos mayores permanezcan en sus domicilios hasta que fallezcan, y en caso de que se quiera presentar un despojo, esta cláusula les permite revertir jurídicamente la herencia o donación del bien inmueble.
Montoya de la Rosa, enfatizó que este tipo de casos, en los que los adultos mayores pierden su patrimonio “lamentablemente cobra mayor relevancia en quienes tienen menos grado de escolaridad y en mayor margen de pobreza, ya que, al no contar con la asesoría indicada, muchas veces, por un acto de amor o incluso de presión, se desprenden de lo que en la mayoría de ocasiones es el único fruto de toda una vida de trabajo, es decir su vivienda”
