Considerará Congreso de Nayarit otorgar el derecho al voto a presos
Analizarán la iniciativa para reformar la Constitución local y la Ley Electoral
Tepic, 13 de junio de 2022.- Con el interés de garantizar el respeto de sus derechos a las personas privadas de su libertad, el Congreso del Estado de Nayarit que preside la legisladora Alba Cristal Espinoza Peña y los representantes populares de todas las fuerzas políticas, analizarán la iniciativa para reformar y adicionar diversos artículos de la Constitución Política local y la Ley Electoral del Estado de Nayarit en materia de voto activo para personas que se encuentran bajo prisión preventiva.
En el contenido de la propuesta se destaca que, en la actualidad, las personas privadas de su libertad tienen imposibilidad física y jurídica para ejercer su derecho a votar, ello por tratarse de una medida la suspensión de los derechos político-electorales, por tanto, la propuesta permitirá que los presos sin sentencia serán tratados como inocentes y así ejercer su derecho al voto.
La iniciativa señala que el voto activo de las personas privadas de su libertad es una herramienta que le da voz y constituye una medida de inclusión que contribuye a una democracia que no discrimina, sino que abona al reconocimiento de los derechos humanos de su ciudadanía.
Con ello, las personas recluidas por prisión preventiva podrán participar con su voto activo para elegir y legitimar a quienes serán sus representantes en los diferentes cargos de elección popular, y con ello recibir la tutela y respeto de sus derechos fundamentales.
La propuesta en la que se pretende reformar la fracción segunda del artículo 19; la adición de un párrafo tercero a la fracción I del artículo 17 y la derogación de la fracción V del artículo 19 de la Constitución Política del Estado y la reforma a la fracción VIII del artículo 5 de la Ley Electoral del Estado de Nayarit, será estudiada por las y los diputados de esta 33 Legislatura, para después discutirla y en su caso aprobarla en Sesión Pública Ordinaria.
